The marriage must be based on good faith. However, US Citizenship and Immigration Services does deny Residency Petitions to married couples it deems are not engaged in a “good faith” marriage.
To overcome this denial, the Petitioner must go to court.
Needless to say, it is better to avoid this denial in the first place.
Here Are Five Reasons Why USCIS Might Think Your Marriage Is Fake Or Not Based On Good Faith
1. You don’t live together.
2. You don’t have a joint bank account.
3. You don’t speak the same language.
4. There is a huge age difference between you and your spouse, especially if it’s a younger man with a very old woman.
5. A very attractive immigrant with a very ugly US citizen.
No singular factor above is dispositive.
Marrying to obtain a US citizenship is not a crime or sufficient grounds for the USCIS to deny your Residency Petition if there are other legitimate reasons for the marriage.
However, where that is the only reason for the marriage, it thus serves as sufficient grounds for denial of your Residency Petition and can be grounds for criminal prosecution for Marriage Fraud.
